Terms & Conditions (Rehearsal Room – Pure Room Rental)

Scope: These Terms apply to the pure rental of rehearsal rooms (bloße Vermietung von Proberäumen) in the Operator's business premises (Geschäftslokal) . The Operator does not provide any additional services for a fee beyond room rental.
0. Definitions & Key Principles
- Operator = drop (Kerem Uzgören).
- Customer = person or group renting a room.
- Pure room rental (non-Gewerbe) = access to a room and its fixed inventory for private rehearsal. No event operation, no audience, no staffed services (only self-engineering, self-recording, self-production by customer), no selling of food/drinks, and no public performances.
- Customer Equipment = instruments/devices brought and operated by the Customer.
- Session = booked limited time slot.
- No Commerce (Non-Gewerbe) declaration: The Operator runs a pure room rental activity and does not operate a permit-required industrial plant under §74 GewO. No services are offered for a fee or charged beyond the rental itself. If a Customer requires staffed services (e.g., an audio engineer, recording service, event), that is outside these Terms and not provided. The drum kit/PA/mixer/keyboards, etc. are a permanent part of the rehearsal room's equipment (inventory). There is no separate charge, no separate booking, no handover as a separately rented item, and nothing may be taken off-site — therefore, this is not equipment rental. The customer rents the room as a rehearsal space (including its fixed equipment), not 'equipment'.
1. General Terms
- These Terms apply to all bookings made with drop located at Gentzgasse 3, 1180 Vienna. By booking and using our facilities, you agree to abide by these Terms and the House Rules.
- Permitted use: private rehearsal/practice/jamming, self-music production and directly related activities consistent with pure room rental. Any other use must be approved in writing in advance and may require different legal/permit frameworks.
- No public events / no audience: No venue operation / non-public use. The facility is not operated as a venue. Sessions are strictly non-public. No audience admission, no ticket sales, no catering, no concerts, and no club/DJ operation are permitted. Bookings cover pure room rental only; no staffed services (e.g., recording or live sound engineering) are sold.
2. Booking & Payment (Room Rental Only)
- All bookings are made in advance via our website and constitute room rental only.
- No additional services are provided or charged (no engineering/staffed operation, no paid recording, mixing or mastering services and no catering).
- Full payment is required at the time of booking unless otherwise agreed.
- Minimum booking length: 1 hour.
- Prices may change prospectively; confirmed bookings are unaffected.
- Booking confirmation is sent via email.
- Overstay: If the Customer stays ≥10 minutes beyond the booking, an extra full hour is charged. The last 5 minutes of each Session are reserved for packing up and vacating the room.
- Identification & minimum age: We may request a photo ID. Minimum age 18 (or accompanied by a responsible adult). We may refuse bookings or remove individuals who breach these Terms.
3. Cancellation & Refunds
- 48 h before start: full refund.
- 24–48 h: 50% refund.
- <24 h / no-show: no refund.
- If the Operator cancels: full refund of fees paid.
- Force majeure & maintenance: We may cancel or reschedule Sessions due to maintenance, safety directives, regulatory requirements, or events beyond our control. Liability is limited to a refund of the rental fee.
4. Use of Studio Facilities (Permitted / Prohibited)
- The rehearsal room may be used only during the booked period. No automatic right to extend. Extensions may be granted subject to availability.
- Prohibited uses: physical public events, audience admission, ticket sales, hospitality, open house DJ club-like operation.
- Room condition: Leave rooms and common areas as found; remove rubbish when leaving. Cleaning fees may apply otherwise.
- Keep doors and windows closed at all times; do not prop them open.
- Damage: Customers are liable for damages to rooms/equipment/facilities incurred during their Session and must report them immediately.
- Illegal activities: Not permitted; the Operator accepts no responsibility.
5. Equipment Damage & Theft
- Use in-room equipment responsibly; misuse or negligence incurs repair/replacement at Customer's cost.
- The Operator may inspect equipment pre/post Session.
- Theft will trigger legal action, permanent ban, and full financial liability.
- Customers must test gear before use and notify the Operator immediately of faults.
6. Safety & House Rules
- Follow health & safety rules; keep walkways clear.
- In emergencies, follow marked evacuation routes and fire exits.
- First aid supplies are available; report injuries immediately.
- Misuse of equipment may result in Session termination without refund.
- No smoking inside; no alcohol or illegal substances on the premises.
7. Noise & Neighbor Protection (Legal Limits)
- Goal: protect neighbors and ensure compliance with applicable acoustic standards used in Vienna (e.g., ÖNORM S 5004 / ÖAL-3 framework), without converting the bookings into an event or staffed service.
- In-room level limits (source limits): Unless otherwise posted in writing, the Customer must keep in-room levels within: LAeq,Session ≤ 95 dB(A) and peaks ≤ 105 dB(A) (fast/impulse as posted). The limits are based on a court-accredited expert report under ÖNORM S 5004 / ÖAL-3, assessing indoor receiver targets (LPB) for day/evening with neighbor windows closed.
- Limiter requirement & anti-tampering: By booking you agree to level limiters and logging. Bypassing or tampering with limiters, loggers, doors or sensors is prohibited and may result in immediate termination without refund, account suspension, and a liquidated damages charge of EUR 250 plus actual costs.
- Availability / Quiet & Night Times: Bookings run 08:00–22:00. Night use (22:00–06:00), Sundays and public holidays are not permitted unless expressly approved in writing.
- Testing & cooperation: On request, Customers must cooperate with on-site checks (short level tests) to verify compliance.
- Breach & remedies: Exceeding limits or ignoring staff instructions may lead to immediate termination of the Session without refund, surcharge for related costs, and potential exclusion from future bookings.
- Note: The above limits are operational caps for pure room rental. They are not an invitation to disturb; Customers must always avoid causing unreasonable annoyance or disturbance, including in common areas and on approach/exit routes.
8. Security & Surveillance
- For security (especially burglary/theft protection), the entrance and studios are video-monitored. By using the studio, you consent to being recorded on premises.
- Footage is handled under applicable privacy law and used only for security, safety, and law enforcement.
- Storage period: CCTV footage is retained for up to 72 hours (longer only if secured for an incident). Sound level logs are retained for up to 180 days to verify compliance and defend legal claims, then deleted. No profiling or advertising.
9. Liability
- The Operator is not liable for personal injury or loss/damage to Customer property.
- Customers use rooms and equipment at their own risk and are responsible for their guests.
- Customers must carry any required insurance for their equipment and activities.
10. Access & Conduct
- Access is limited to the booked slot. Arrive and vacate on time.
- An access code is provided for the booked time and must not be shared publicly.
- The booking person is liable for additional guests and must inform staff of guest numbers.
- Subletting or transfer of a booking to third parties is not allowed without consent.
11. Privacy & Data
- We process personal data (e.g., IP, name, email, phone, address, payment data) to handle bookings and communication, in accordance with law and our Privacy Policy (link on website).
- You may request information, correction, blocking, or deletion of your data where legally permitted.
12. Animals
- Animals only with prior approval; must be supervised at all times.
- The person bringing an animal must hold suitable liability insurance and is responsible for all damages.
13. Compliance & Legal Framework (Non-Gewerbe)
- Pure rental only: The Operator's activity is limited to pure rental (bloße Vermietung) of rehearsal rooms and does not operate a permit-required industrial plant under §74 GewO. No commerce (Gewerbebetrieb) within the meaning of event/club/venue or staffed recording services is conducted under these Terms.
- No commercially operated facility (keine Betriebsanlage): The Operator does not operate a commercial facility within the meaning of these Terms. If a Customer proposes an activity that would require such a framework, the booking will be refused or cancelled.
- Customer duty: Customers must conduct themselves so that no unreasonable disturbance arises for neighbors; this includes respecting posted hours, level caps, and house rules.
14. Amendments
- The Operator may amend these Terms at any time. Changes will be communicated via the website or email and apply prospectively.
15. Governing Law, Jurisdiction & Language
- Austrian substantive law applies (excluding CISG). Mandatory consumer protection laws at the Customer's habitual residence also apply for consumers.
- If the Customer is a consumer under the Austrian Consumer Protection Act (KSchG), jurisdiction lies with the court of the Customer's domicile, habitual residence, or place of employment. Otherwise, the court competent for the Operator's seat has jurisdiction.
- Place of performance and jurisdiction: Vienna.
- Languages: English and German. In case of discrepancy, the German version prevails. (We provide a German version.)
- Severability: If any provision is invalid, the remainder remains effective.
- Entire agreement: These Terms constitute the entire agreement for pure room rental of rehearsal rooms.

Appendix A – Practical House Rules
- Respect neighbors when entering/leaving; keep doors closed; no loitering or noise in common areas.
- Use in-ear monitors/headphones if requested during any temporary approval phase.
- Keep ventilation paths unobstructed; report any defects immediately.
- Adhere to posted occupancy and emergency procedures.
